Terms and Conditions

These Terms and Conditions govern your use of the website located at theexpatescapeplan.com and any general relocation education, planning, or consulting services offered by The Expat Escape Plan LLC (“The Expat Escape Plan,” “Company,” “we,” “us,” or “our”).
Please read these Terms carefully. By using this website, submitting an inquiry, or purchasing or booking a consultation after booking becomes available, you acknowledge that you have reviewed these Terms. A consultation purchase will also require affirmative acceptance of these Terms and our Consultation Disclaimer.
1. About Our Services
The Expat Escape Plan provides general relocation education, destination research, practical planning assistance, and consulting based on personal experience, local knowledge, publicly available information, and information supplied by clients.
Consultations may address subjects such as destination comparisons, budgeting, housing considerations, transportation, healthcare research, daily logistics, cultural adjustment, border crossings, relocation priorities, and questions clients may wish to investigate further.
Our services are intended to help clients organize their research and make more informed personal decisions. We do not make relocation decisions on behalf of clients.
2. Eligibility
You must be at least 18 years old and legally capable of entering into an agreement to purchase or book a consultation.
If you purchase a consultation on behalf of another person or organization, you represent that you have authority to accept these Terms on that person’s or organization’s behalf.
3. Educational Information and No Professional Advice
General relocation consultations are educational and planning-oriented. Unless a separate written agreement expressly states otherwise, information provided through this website, email communications, downloadable materials, or consultations is not legal, immigration, tax, accounting, financial, investment, medical, mental-health, or other regulated professional advice.
You remain responsible for consulting appropriately licensed professionals before making decisions that require professional advice.
4. Ecuadorian Legal Services Are Separate
General consultations do not create an attorney-client relationship with Genesis Espinoza, The Expat Escape Plan, or any affiliated person.
Any formal Ecuadorian legal service, legal representation, legal opinion, document preparation, or other attorney service must be evaluated separately and, when appropriate, governed by a separate written legal-services agreement that identifies the attorney, client, scope of representation, fees, jurisdiction, and applicable professional obligations.
The Expat Escape Plan does not provide legal representation concerning the laws of countries or jurisdictions in which the relevant person is not properly authorized to practice law.
5. Consultation Options and Scope
Available consultation options, durations, prices, and included services will be described on the Work With Me or booking page. We may update those offerings before a purchase is completed.
A consultation includes only the time and services specifically described at the time of purchase. Written reports, ongoing research, document review, follow-up work, application assistance, recordings, or additional meetings are not included unless expressly stated in writing.
Purchasing a consultation does not create an ongoing advisory, fiduciary, agency, employment, partnership, or attorney-client relationship.
6. Prices and Payment
Consultations must be paid in full before an appointment is confirmed unless we expressly agree otherwise in writing.
Prices are displayed in United States dollars unless another currency is specifically identified. Clients are responsible for any currency-conversion charges, international transaction fees, bank charges, taxes, or similar costs imposed by their financial institution or applicable law.
Payment processing may be handled by a third-party payment provider. We do not directly control that provider’s systems, security procedures, processing times, or separate terms.
7. Rescheduling by the Client
A client may request one reschedule by providing at least 24 hours’ notice before the scheduled starting time.
Rescheduling is subject to availability. The replacement appointment must generally be scheduled within 60 days of the original appointment unless we approve a different arrangement in writing.
Requests made with less than 24 hours’ notice may be treated as a late cancellation and are not automatically eligible for rescheduling. We may make exceptions for genuine emergencies at our sole discretion, but an exception in one situation does not require us to make the same exception in another.
8. Refund and Cancellation Policy
Consultation payments are generally nonrefundable because appointment time is reserved and preparation may begin before the meeting.
A client who provides at least 24 hours’ notice may use the one-time rescheduling option described above. A cancellation does not automatically entitle the client to a refund.
Any discretionary refund approved by us may be reduced by payment-processing charges or other amounts that a third-party processor does not return, to the extent permitted by applicable law.
Nothing in these Terms eliminates any non-waivable refund, cancellation, or consumer-protection right provided by applicable law.
9. Cancellation or Rescheduling by Us
If we must cancel a consultation and cannot provide the purchased service, the client may choose between rescheduling the appointment or receiving a refund of the amount paid for the affected consultation.
We are not responsible for indirect expenses a client incurs in anticipation of a consultation, including travel, lodging, missed work, professional fees, or purchases from third parties.
10. No-Shows and Late Arrivals
A client who has not joined the appointment or contacted us within 15 minutes after the scheduled starting time may be considered a no-show.
A no-show consultation is treated as completed for scheduling and payment purposes. The payment is forfeited, and a replacement appointment is not automatically provided.
If a client arrives late, the consultation will normally end at the originally scheduled ending time so that later appointments are not disrupted. The full consultation fee remains due.
11. Client Responsibilities
Clients agree to provide accurate and complete information relevant to their questions and goals. Our guidance may be limited or inaccurate when important information is missing, outdated, incomplete, or incorrect.
Clients are responsible for independently verifying government requirements, visa rules, residency rules, taxes, healthcare requirements, housing conditions, costs, safety information, and other material facts before taking action.
Clients must not send passwords, complete financial account information, highly sensitive identity documents, or other unnecessary confidential information through ordinary email or website forms.
12. No Guaranteed Outcome
We do not guarantee that a client will qualify for a visa or residency status, obtain government approval, find housing or employment, save money, avoid losses, successfully relocate, enjoy a destination, or achieve any other specific result.
Government policies, prices, availability, exchange rates, political conditions, safety conditions, professional requirements, and personal circumstances may change without notice.
13. Third-Party Services and Referrals
We may mention or link to third-party websites, professionals, businesses, booking systems, payment processors, government agencies, housing platforms, insurance providers, transportation companies, or other services.
A reference or referral does not guarantee quality, availability, licensing, suitability, pricing, accuracy, or results. Third parties operate independently and may have their own terms, privacy practices, fees, and requirements.
Clients are responsible for evaluating third-party providers and entering into separate agreements with them when appropriate.
14. Consultation Recordings and Materials
Neither party may record a consultation without the express knowledge and consent of everyone participating.
Unless otherwise stated in writing, consultation notes, worksheets, plans, templates, videos, written materials, and other resources supplied by us are provided for the purchasing client’s personal, noncommercial use.
Clients may not reproduce, publish, sell, distribute, license, upload, teach from, or commercially exploit our materials without prior written permission.
15. Website Use
You agree not to misuse the website, interfere with its operation, attempt unauthorized access, introduce malicious software, impersonate another person, submit fraudulent information, scrape protected content, or use the website for an unlawful purpose.
We may restrict access, decline service, cancel a booking, or end a consultation when a person behaves abusively, threatens another person, engages in fraud, requests unlawful assistance, or materially violates these Terms. Any refund in such a situation will depend on the circumstances and applicable law.
16. Intellectual Property
The website and its original text, branding, graphics, videos, photographs, downloads, consultation materials, organization, and other original content are owned by or licensed to The Expat Escape Plan and are protected by applicable intellectual-property laws.
No ownership right is transferred merely because you access the website or purchase a consultation.
17. Website Availability and Accuracy
We try to provide useful and accurate information, but we do not promise that every page, price, link, statement, or resource will always be complete, current, uninterrupted, or error-free.
We may correct errors, update information, modify services, temporarily suspend features, or remove content without prior notice.
18. Disclaimer of Warranties
To the maximum extent permitted by law, the website, general information, and consulting services are provided on an “as available” and “as is” basis without warranties of a particular outcome, fitness for a particular purpose, uninterrupted availability, or error-free operation.
Nothing in these Terms excludes a warranty or legal protection that cannot lawfully be excluded.
19. Limitation of Liability
To the maximum extent permitted by law, The Expat Escape Plan and its owners, personnel, advisors, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from the use of the website, reliance on general information, relocation decisions, third-party conduct, or inability to access a service.
To the maximum extent permitted by law, our total liability arising from a particular paid consultation will not exceed the amount the client paid to us for that consultation.
These limitations do not apply when liability cannot legally be limited or excluded.
20. Payment Disputes and Chargebacks
If you believe a payment was processed incorrectly or a purchased service was not provided as agreed, please contact us promptly so that we can investigate and attempt to resolve the matter.
Submitting false information or initiating a fraudulent payment dispute may result in cancellation of services and the submission of relevant records to the payment processor or financial institution. Nothing in this section restricts a client from exercising legitimate rights under applicable law.
21. Governing Law and Disputes
These Terms and any general relocation consulting agreement will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except when applicable consumer law requires otherwise.
Before filing a legal claim, the parties agree to make a reasonable good-faith effort to resolve the dispute through written communication.
If a dispute cannot be resolved informally, it may be brought before a court of competent jurisdiction in Florida, unless applicable law requires a different jurisdiction or venue.
Separate Ecuadorian legal services are not governed by this general consulting provision when a separate written legal-services agreement states different governing terms.
22. Changes to These Terms
We may revise these Terms as the website, services, business structure, booking process, payment process, or applicable requirements change.
The updated version will be posted on this page with a revised effective date. Terms applicable to a completed purchase will generally be the version presented when the purchase was made, unless a change is required by law or the parties agree otherwise.
23. Severability and No Waiver
If any portion of these Terms is determined to be invalid or unenforceable, the remaining portions will continue to apply to the extent permitted by law.
A delay or failure to enforce a provision does not permanently waive the right to enforce that provision later.
24. Entire Agreement
These Terms, the Privacy Policy, the Consultation Disclaimer, the applicable booking-page description, and any written service-specific agreement constitute the agreement concerning general website use and relocation consulting services.
If a separate written agreement directly conflicts with these Terms concerning a specifically identified service, the separate written agreement will control for that service.
